1. Scope and Operator Information
These Terms and Conditions ("Terms") govern the use of the mobile and/or web application PromoPal ("App"), operated by PromoPal, Germany ("Operator", "we", "us").
The App is available worldwide. By accessing or using the App, you agree to be bound by these Terms.
2. Description of the Service
The App allows users to store personal voucher codes and referral links and to share referral links with other users of the App.
The App can be used with or without creating an account. Certain features, such as sharing referral links, require account registration.
3. Eligibility
The App is intended for users who are legally capable of entering into binding agreements. If you are under the age of majority in your country, you may only use the App with the consent of a legal guardian.
4. Account Registration
Creating an account is optional. If you choose to register, you must provide a valid email address and a password.
You are responsible for maintaining the confidentiality of your login credentials and for all activities carried out under your account.
We reserve the right to suspend or terminate accounts that violate these Terms.
5. User Content and Responsibility
Users may store and share voucher codes and referral links ("User Content").
By using the App, you confirm that:
- You have the right to store and share the User Content
- The User Content does not violate any applicable laws or third-party rights
- The User Content is not misleading, fraudulent, or harmful
We do not verify, endorse, or guarantee the validity or effectiveness of any voucher codes or referral links.
6. Prohibited Use
You may not:
- Use the App for unlawful or fraudulent purposes
- Upload malicious code or attempt to disrupt the App
- Infringe intellectual property or third-party rights
- Misuse referral links in violation of third-party terms
7. Availability and Changes
We strive to keep the App available but do not guarantee uninterrupted or error-free operation.
We reserve the right to modify, suspend, or discontinue features, introduce paid services, or update these Terms at any time. Changes become effective upon publication.
8. Fees and Paid Features
The App is currently provided free of charge.
We reserve the right to introduce paid features, subscriptions, or premium services in the future. Any paid features will be clearly communicated prior to purchase.
9. Intellectual Property
All rights to the App, including software, design, and branding, remain with the Operator.
Users receive a non-exclusive, non-transferable right to use the App in accordance with these Terms.
10. Disclaimer
The App is provided on an "as is" basis.
We do not guarantee the availability, accuracy, or effectiveness of voucher codes or referral links or that users will receive any benefits or rewards.
11. Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect or consequential damages, loss of data, profits, or business opportunities, or issues arising from third-party services.
This does not apply to liability for intent, gross negligence, or mandatory statutory liability under German law.
12. Termination
You may stop using the App at any time.
We may suspend or terminate access if these Terms are violated or if continued operation is no longer feasible.
13. Applicable Law and Jurisdiction
These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
If legally permissible, the place of jurisdiction is Germany.
